Compliance requirements
The tender documents include the standard exclusion grounds. The bidder must confirm that none of the mandatory exclusion grounds apply, including participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. If an exclusion ground exists, the bidder may, where allowed, provide evidence of self-cleaning. The machine-readable notice does not provide a complete plain-language list of all exclusion grounds; the exact grounds and any required confirmations must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have a valid licence to provide audit services in Estonia and must be registered in the audit activity register. A foreign bidder must be registered with the competent authority in its country of establishment or otherwise be entitled to provide audit services under the law of that country, and where necessary must also be entitled to operate in Estonia in line with the Audit Activities Act. The foreign bidder must submit a certificate from the competent authority or another relevant document. The bidder must have professional indemnity insurance covering the annual value of the offered service; the minimum insured amount is EUR 30,000. During the last 36 months, the bidder must have properly audited at least two public sector entities, at least one of which must be a local government consolidation group with assets of at least EUR 75 million and revenue of at least EUR 30 million, and at least one member of the Estonian Hospital Association with revenue of at least EUR 30 million. The bid must include a list of those contracts with dates of conclusion, value and the other contracting parties, together with confirmation that the work was carried out in accordance with the contracts and good practice. In a joint bid, a power of attorney and separate ESPDs for all joint bidders must be submitted. If the bidder relies on another undertaking’s resources, that undertaking’s consent must be provided. The bid must comply with the tender documents, and where relevant equivalence must be explained and supporting evidence attached. The bid price must be submitted in the required structure and on Annex 2 Form 4.
