Compliance requirements
The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents. The ESPD requires the bidder to confirm whether it or its management body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, or child labour and other forms of human trafficking. If an exclusion ground applies, the bidder may provide evidence of self-cleaning measures where allowed.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; they must be checked in the tender documents. The ESPD indicates that the bidder must confirm whether any of the listed exclusion grounds apply and, where permitted, provide information on self-cleaning measures. The compliance conditions require confirmation that the bid complies with the procurement documents, submission of the price form, confirmation of compliance with environmental requirements, submission of a joint-bidder power of attorney if applicable, and confirmation that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act will be used. A mandatory guided site visit is required.
