Renting Adobe software licences

The contracting authority will exclude a bidder if any mandatory exclusion ground applies: conviction for participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorist offences or incitement/assistance/attempt, money laundering or terrorist financing; unlawful employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; illegal use of child labour or human trafficking-related offences; tax, duty or environmental charge arrears, or social security contribution arrears under the laws of the bidder’s country of establishment; or if awarding the contract would breach an international sanction or a Government of the Republic sanction. The bidder must confirm that no mandatory exclusion grounds apply.

The machine-readable notice did not include any precise qualification or selection criteria. The tender documents require the bidder to submit the application for participation, the detailed price form, and, if applicable, the joint bidders’ power of attorney. The bid must be unconditional and must comply with all tender documents. If the bidder wants to mark information as a trade secret, it must briefly describe the secret and explain why it is treated as such; the bid price and other price-related numerical indicators that are used for evaluation cannot be marked as trade secrets. If the bidder offers other Adobe software licences in addition to those listed in the technical specification, a list of those licences with monthly rental unit prices excluding VAT must be submitted.
