Compliance requirements

The bidder must confirm the exclusion grounds set out in the ESPD and tender documents. The notice covers convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activities, money laundering or terrorist financing, and child labour or other forms of trafficking in human beings. If applicable, the bidder must also provide a description of self-cleaning measures and any electronically available evidence. The subcontractor control documents also require confirmation that subcontractors do not have the exclusion grounds listed in the tender documents.

Qualification criteria and exclusion grounds

The bidder must provide the confirmations and evidence required in the ESPD and the compliance conditions. In the ESPD, the bidder must confirm the absence of the relevant exclusion grounds for the bidder and its management bodies, and provide self-cleaning details and evidence where applicable. Under the compliance conditions, the bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents, or entities established in the Russian Federation, or persons/entities owned or controlled by them. In a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also explain any business secret markings and confirm that no subcontractor subject to replacement under RHS § 122(7) will be used. Subcontractors must submit the ESPD during contract performance.
