Compliance requirements

The tender documents set out the exclusion grounds. The contracting authority excludes a bidder, for example, if the bidder or its representatives have been convicted of corruption, fraud, terrorist offences, money laundering or financing terrorism; if the bidder has tax or social security debts; or if contract award would breach international or government sanctions. The contracting authority may also exclude a bidder for serious breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive conduct, conflicts of interest, misleading information, repeated serious contract breaches, or lack of the right to submit a tender. The bidder must also provide the required confirmation form and, if relying on another undertaking’s resources, a confirmation of no exclusion grounds for that entity as well.

Qualification criteria and exclusion grounds

The bidder must have, during the period from 01/01/2023 until the date the contract notice was published, either taught an electrical subject within formal education or delivered electrical group training totalling at least 200 contact teaching hours. The bidder must submit the qualification data form and indicate whether it relies on another entity’s resources to meet the qualification requirement. The bidder must also confirm that it has not materially breached administrative contracts and that there are no circumstances that could cause persistent insolvency or cessation of activities. If the bidder relies on another undertaking’s resources, it must also provide the no-exclusion-grounds confirmation for that entity. The tender documents also require the trainer names, copies of documents proving vocational or higher education, the training location address, and the curriculum form.
