Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour and other forms of trafficking in human beings. The bidder or members of its management bodies must not have a current final conviction for these grounds within the last five years, unless the law or the tender documents provide otherwise. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed by law or the tender documents. The subcontractor control document also requires first-tier subcontractors to be checked for certain exclusion grounds during contract performance.

Qualification criteria and exclusion grounds

The bidder must have an average annual turnover of at least EUR 400,000 for the period 1 January 2023 to 31 December 2025. The bidder must have properly completed at least two contracts in the last 60 months before the start of the procurement, where a wastewater treatment plant with a pollution load of at least 5,000 ie was built, reconstructed or rebuilt to improve energy efficiency. At least one of those contracts must have included installation or upgrading of a SCADA remote monitoring and control system for a wastewater treatment plant. The bidder’s team must include a project manager, site manager, design team leader, and an electrical, automation and SCADA specialist with the required professional qualifications or equivalent certificates. The bidder must also provide the employer’s confirmation for the key person, the subcontractor form if subcontractors are used, the list of unit prices, and a power of attorney if the signatory is not authorised to sign.
