Compliance requirements

The contracting authority will exclude a bidder if the bidder or its management, administrative or supervisory body member, proxy or other authorised representative has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or incitement, aiding or attempting such an offence, money laundering or terrorist financing. Exclusion also applies if the bidder or such person has been convicted for enabling work for a foreign national staying in the country without legal basis or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, or for illegal use of child labour or human trafficking. A bidder is also excluded if it has tax, duty or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, or if the bidder has provided false information about compliance with qualification requirements or failed to submit required additional documents. The bidder must confirm that none of these mandatory or voluntary exclusion grounds apply. The notice also restricts participation by companies established in Russia or Belarus.

Qualification criteria and exclusion grounds

During the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party (including the client representative’s phone number and email address) and, for public procurements, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The bidder’s team must include a person with valid switching authorisations who is entered in Elektrilevi’s partner portal before the deadline for submitting tenders. The team must also include a person appointed as responsible for the work operation, entered in the partner portal before the deadline. In addition, the team must include a lead electrical worker with valid A-competence or, under the Vocational Education Act, at least level 6 qualification, who has the relevant certificate at the time of submission and is entered in the partner portal before the deadline. The tender must include a price table in the form required by the tender documents, with all unit price fields completed. The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included.
