Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the employment of a foreign national staying in the country illegally or violating the conditions for employing a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the bidder’s country of establishment; or a breach of an international sanction or a sanction of the Government of the Republic. In addition, the bidder’s place of residence or establishment may not be in the Russian Federation or the Republic of Belarus, because the contracting authority has restricted participation based on the bidder’s country of residence or establishment. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment, if this is required by the laws of that country. If registration is required, the bidder must submit a copy of the relevant proof of registration. A bidder established in Estonia does not need to submit a registry extract proving registration in the commercial register. The bidder and/or its subcontractor must have performed at least 1 similar contract during the last 36 months before the start of the procurement, with the subject being loading or unloading of bulk solid materials from railway wagons, and with a total value of at least EUR 100,000. The bidder must submit a list of the main contracts performed by the bidder and/or its subcontractor during the last 36 months, including information on their value, dates and the other contracting parties, using the form "List of contracts". The bidder must also provide a list of the equipment to be used for contract performance and its main parameters.
