Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorism-related offence, money laundering or financing of terrorism. A bidder is also excluded if the bidder or its representative has been convicted of unlawful employment of foreign workers, breach of the conditions for employing a foreign national, or offences involving child labour or human trafficking.
Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment, or where the bidder or a member of its management body is subject to an international sanction and the contract would breach that sanction.
The contracting authority may also exclude a bidder if the bidder has breached environmental, social or labour-law obligations, is bankrupt or being wound up, has seriously breached professional conduct rules, has distorted competition, has an unresolvable conflict of interest, has previously materially breached a public contract, has provided false information, or has tried to influence the contracting authority or obtain confidential information. Exclusion may also be based on a tax offence or a statutory prohibition on submitting a bid.
The bidder must confirm that none of these exclusion grounds apply to it in this procurement notice and tender documents.
The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must have a net turnover of at least EUR 200,000 in each of the last three completed financial years. The bidder must submit an extract from the financial statements for the last three completed financial years showing the net turnover, unless the data is publicly available to the contracting authority from a register for a bidder registered in Estonia as a legal person. If the bidder’s financial year does not coincide with the calendar year, the turnover requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the bid submission date.
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have a value of at least EUR 200,000 excluding VAT. The bidder must provide a list of the contracts, including the performance period, information about the other contracting parties (including the client representative’s contact details, such as phone number and email address), and, in public procurements, the reference numbers. On request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information from public or private databases without significant cost.
The bidder’s team must include a person with valid switching rights for work-related switching in the 0.22–20 kV electricity network, and that person must be entered in Elektrilevi’s partner portal before the bid opening. If only low-voltage works (0.22–1 kV) are procured, at least low-voltage switching rights are required; in other cases both low-voltage and medium-voltage switching rights are required.
The bidder must have a person responsible for the work operation, entered in Elektrilevi’s partner portal before the bid submission deadline.
The bidder’s team must include a person managing electrical works who has valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, has the relevant proof at the time of bid submission, and is entered in Elektrilevi’s partner portal before the bid submission deadline.
The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included in the bid.
The bid must include a price table in the form required by the tender documents, and all unit price fields in the price table must be completed.
The bidder must confirm that the bid complies with the conditions set out in the tender documents and that no conditional or additional reservations are made.
The bidder must confirm that the standard payment term is accepted. If the bidder joins the contracting authority’s factoring programme, the payment term is 95 calendar days from the date the invoice is received by the client.
If the bidder is a joint bid, the joint bidders must appoint one authorised representative from among themselves for actions related to the procurement and the contract. If it is a joint bid, a joint power of attorney must be attached.
