The bidder must confirm that none of the exclusion grounds under § 95(1) of the Public Procurement Act apply: no convictions related to criminal organisations, corruption, fraud, money laundering or terrorist financing, no offences related to illegal employment of foreign nationals, no offences related to child labour or trafficking in human beings, no tax debt, and no status as a subject of international sanctions. The bidder must also confirm that it is not barred from submitting a tender because of its country of establishment or residence, if the contracting authority has imposed such a restriction.

The bidder must be registered in the commercial register or another equivalent register of its country of establishment, if required by that country’s law. For bidders registered in Estonia, the contracting authority checks the data itself. The machine-readable notice did not include any other precise qualification, suitability or financial requirements; these must be checked in the tender documents.
