Compliance requirements
The bidder must confirm that no exclusion grounds under § 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account § 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been opened against it, and its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee or environmental charge arrears, or tax or social security contribution arrears, under the law of its country of establishment. In addition, the bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. For the average wage condition, the bidder must confirm that during the reference period its employees’ average wage was above 70% of the average wage for the same period in the relevant field, and it must provide an extract from the Tax and Customs Board or an equivalent authority for foreign bidders; in a joint tender, the proof is required from each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or attached water supply or sewerage systems. For electrical works, the bidder must have a business activity notice for electrical works covering construction and installation of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least twice the expected contract value, excluding VAT. The bidder must be able to provide a performance security equal to 5% of the contract value by the contract date or within 10 calendar days after signing; a deposit to the beneficiary’s bank account or notary account is also accepted if the beneficiary remains the entitled party throughout the construction period. The bidder must have completed at least one equivalent construction work within the last 60 months before publication of the procurement procedure, with a value of at least half of the expected contract value excluding VAT. Equivalent work means construction, extension or full-building reconstruction as main contractor, including at least structural and external envelope works, heat-recovery ventilation works, and heating system works. The bidder must provide the project manager’s name and professional certificate number; the project manager must have at least level 6 construction engineer or construction manager qualification with the required specialisation. The bidder must provide the site manager’s name and certificate number; the site manager must have at least level 5 construction work manager qualification. The bidder must provide the ventilation and heating systems specialist’s name and certificate number; the specialist must have at least level 6 qualification or equivalent competence. The bidder must provide the water supply and sewerage systems specialist’s name and certificate number; the specialist must have at least level 6 qualification or equivalent competence. The bidder must provide the electrical works specialist’s name and certificate number; the person must have at least a B-class competence certificate or level 6 electrical engineer qualification. The bidder must also have a quality management system meeting at least EVS-EN ISO 9001 and an environmental management system in the construction field. If the machine-readable notice did not include precise details for any requirement, they must be checked in the official tender documents.
