Compliance requirements

The bidder must confirm the standard exclusion grounds: participation in a criminal organisation, corruption, fraud and other convictions or prohibitions listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The compliance conditions also include a sanctions requirement: the bidder must not involve subcontractors or suppliers representing more than 10% of the contract value if they are Russian citizens, residents or undertakings established in Russia, or persons or entities controlled by them or acting on their instructions. The contracting authority will reject a bid if the resulting contract would be void under the sanctions rules.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least one contract within the 72 months before the publication of the contract notice, where the subject was the supply, installation and commissioning of a recording and replay system. The installed system must be certified and actually in use for civil air traffic service provision in the European Union during the period 01/01/2021–31/12/2025. The bidder must provide contract details that allow the contracting authority to verify performance: the client’s name and contact details, a precise description of the contract subject, the contract value and performance deadlines, the scope of the delivered solution (voice, screen recording, ASTERIX radar data, event and audit logs), the scope of the hardware and software solution, the storage location solution (on-premise or cloud), and the status of FAT and SAT acceptance tests together with the system commissioning date. If the bidder relies on the resources of another undertaking, the bidder must also provide that undertaking’s details and, if requested, its consent confirming direct participation in performance and joint liability for the part of the contract relied upon. The bid must also include a technical description with a compliance matrix and the bidder’s technical documentation proving compliance with the tender documents.
