Compliance requirements
The bidder must confirm the absence of the mandatory exclusion grounds listed in the tender documents, including convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorism-related offences. The bidder must also confirm that it does not involve a subcontractor that would have to be replaced under the Public Procurement Act, and that it does not use subcontractors or suppliers subject to the EU sanctions restriction on Russian persons or entities for more than 10% of the contract value. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning where allowed.
Qualification criteria and exclusion grounds
The bidder must have a total annual turnover of at least EUR 10,000,000 in each of the last three financial years completed before the start of the procurement, depending on the date of establishment or start of business. For technical and professional capacity, the bidder must have at least 2 properly completed contracts for construction works on publicly used roads, completed within the 60 months before the start of the procurement, with a total asphalt surface layer installed area of at least 20,000 m². The bidder must provide contract descriptions, completion periods, client contact details or procurement reference numbers if the information is available in the public procurement register, and client confirmations if requested by the contracting authority. The bid must comply with the tender documents, be unconditional, include the required price structure and unit prices in euros without VAT to two decimal places, and the bidder must confirm intellectual property rights and the required compliance statements.
