Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, fraud, the commission of a terrorist act or other terrorism-related offences, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may in certain cases submit self-cleaning evidence. The contracting authority may also require replacement of subcontractors if an exclusion ground arises during contract performance. The exact list of exclusion grounds and conditions must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total annual turnover for the last financial year ended before the start of the last three procurement procedures must be at least EUR 10,000,000 per year. For technical and professional capacity, the bidder must have at least 2 properly completed contracts for construction works on public roads within the 60 months before the start of the procurement, with a total of at least 20,000 m² of top-layer asphalt surfacing installed. For each reference contract, the bidder must provide a short description, the performance period, information about the other contracting parties, and, if requested by the contracting authority, a confirmation from the client. The tender must comply with the tender documents, and the tender price must be submitted in the format required in Annex 2. In the case of a joint tender, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bidder must also confirm the existence of the necessary intellectual property rights and that the tender complies with the procurement documents.
