Compliance requirements

The bidder must confirm the mandatory exclusion grounds in the tender documents. These include final convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences and other listed offences. If an exclusion ground applies, the bidder may provide evidence of self-cleaning measures where allowed. The bidder must also confirm anti-corruption compliance and that it has not committed corrupt acts in this procurement. In addition, the bidder must confirm compliance with the EU sanctions rule: subcontractors and suppliers performing more than 10% of the contract value may not be Russian citizens, residents, entities established in the Russian Federation, entities more than 50% owned by such persons or entities, or persons acting on their instructions.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 200,000. The bidder must also have completed at least one similar service contract or order during the 36 months before the start of the procurement. A similar service means a contract or order where the client carried out at least 20 real estate transactions and 10 movable property transactions through the bidder’s auction environment. The bidder must provide the required turnover figures and a list of completed contracts or orders with the requested details. The bidder must have a functioning Estonian-language web-based auction environment that meets the tender documents, and the bidder must allow the contracting authority to review it free of charge by providing the website address and any other information requested for verification. The bid must be submitted in the required structure and the bidder must confirm that the bid complies with the tender documents. If the bidder is a joint tenderer, a power of attorney for the joint bidders must be attached. The bidder must also confirm that the offered solution is an existing and functioning software environment, not a prototype or pilot solution.
