Compliance requirements

The machine-readable notice includes the standard exclusion grounds: the bidder may be excluded if the bidder, its management or supervisory body member, procurator or other authorised representative has been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, financing terrorism, illegal employment of foreigners, child labour or human trafficking. The bidder may also be excluded for tax or social security debt, breach of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive conduct, conflict of interest, distortion of competition, or if the contract would breach an international or government sanction. If an exclusion ground exists, the bidder may be allowed to prove self-cleaning where the tender documents permit it. The exact grounds and any self-cleaning rules must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must demonstrate both financial capacity and team competence. - The combined net turnover for the last three audited financial years must be at least EUR 1,000,000. The bidder must provide the data in the ESPD, and the contracting authority may request extracts from the annual accounts. - If the tender is signed by someone other than the legal representative, a power of attorney must be submitted. - The tender must include the table and confirmations required in the document titled “Overview of completed work”. - The bidder must confirm that it has the intellectual property rights needed to perform the contract and the order. - The bidder must confirm that it has reviewed KeMIT’s technology profile and can carry out the work using the products and technologies listed there. - If needed, the team must be able to include a specialist with prior experience in research and development, including developing a novel technological solution, experimental development, or software development with research and development elements. - To provide the service, separate individuals must be assigned for the entire term of the framework agreement to the following roles: project manager, analyst, full-stack developer, developer, and developer/architect. - The project manager must have at least 3 years of experience as a project manager in software development, participation in at least two software development contracts during the last 48 months, experience managing projects using agile methods, and very good Estonian language skills in speech and writing. - The analyst must have at least 3 years of experience as an analyst in software development, participation in at least two software development contracts during the last 48 months, and very good Estonian language skills in speech and writing. - The full-stack developer must have at least 5 years of experience, participation as a developer in at least two software development contracts using Python during the last 48 months, and good Estonian language skills in speech and writing. - The developer must have at least 2 years of experience, participation as a developer in at least one software development contract using Python during the last 48 months, and good Estonian language skills in speech and writing. - The developer/architect must have at least 3 years of experience as a full-stack developer, participation as an architect and/or developer in at least one software development contract using Python during the last 48 months, and good Estonian language skills in speech and writing. - Each of the listed roles must be filled by a different person. - The contracting authority will verify the team members’ qualifications based on CVs; each CV must be signed by the person concerned. - If the Estonian language requirement for any team member is replaced by an interpreter, the interpreter must have at least B2-level proficiency in both Estonian and the interpreted language, and proof of this must be provided. The cost of the interpreter is borne by the bidder.
