Compliance requirements
The bidder must confirm that neither it nor its management, representation or supervisory body members have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour offences or human trafficking, and that no corresponding exclusion period still applies.
The bidder must also confirm that there are no exclusion grounds arising from breaches of tax, social security or other statutory obligations that would justify exclusion, and that any available self-cleaning measures have been taken. If such a ground exists, the bidder may submit self-cleaning evidence where permitted.
In addition, the bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder may not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or entities established in the Russian Federation, or persons/entities owned or controlled by them or acting on their instructions.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if registration is required under that country’s law. For an Estonian bidder, the commercial register applies. The contracting authority may request evidence of registration.
The bidder’s average net turnover for the last three completed financial years must be at least EUR 80,000 per year for the period 01/01/2023–31/12/2025. Joint bidders may aggregate the figures. The successful bidder must submit extracts from the reports of the last three completed financial years showing the turnover, unless the data are freely and publicly available to the contracting authority from public databases.
For technical capability, the bidder must have properly performed at least one sales contract for a farinograph or a similar laboratory device used to analyse quality indicators, with a value of at least EUR 60,000 excluding VAT, during the 36 months preceding the start of the procurement. If this cannot be checked in public databases, the bidder must provide, on the contracting authority’s request, a confirmation from the buyer or client stating the contract value and completion deadline. The contracting authority recommends submitting this document together with the tender.
To prove compliance, the bidder must submit the technical compliance form containing all information needed to verify that the offered farinograph meets the requirements. The bidder must also confirm that the tender complies with the procurement documents and provide the specification of the offered device. The delivery time including assembly must be no more than 15 weeks from contract signature. The warranty must be at least 24 calendar months from the signing of the handover certificate, and the bidder must describe the warranty maintenance and other warranty conditions.
