Compliance requirements
The bidder must confirm that neither it nor its representatives have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, money laundering, terrorism, human trafficking, labour-law offences or any other exclusion ground listed in the procurement, where applicable.
If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, if permitted. The bidder must also provide the names and personal identification codes of authorised persons, or confirm that there are no such persons, so that the contracting authority can check exclusion grounds for persons not visible in the commercial register.
The bidder must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned areas. The bidder must also confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value who are linked to citizens, residents or entities established in the Russian Federation, in line with the sanctions rules.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by that country’s law. For an Estonian bidder, this means registration in the commercial register. The contracting authority may request evidence of registration.
The bidder’s average annual net turnover for the last three completed financial years before the start of the procurement must be at least EUR 60,000 per year for the period 01/01/2023–31/12/2025. Joint bidders may aggregate the figures. The successful bidder must, if requested, provide extracts from the annual accounts for the last three completed financial years showing the net turnover.
For technical capacity, the bidder must have properly performed at least one sales contract for an amylograph or a similar laboratory device analysing quality indicators within the 60 months preceding the start of the procurement, with a value of at least EUR 35,000 excluding VAT. If this cannot be verified from public databases, a confirmation from the buyer or client must be provided, including the contract value and completion deadline.
For the tender, the bidder must confirm that the tender complies with the procurement documents, that technical compliance is demonstrated using Form 1, and that the specification of the offered device is provided in a free-form document. The bidder must also state the delivery time, which may not exceed 15 weeks, and the warranty period, which must be at least 24 calendar months from the signing of the handover certificate. Warranty terms and maintenance conditions must also be described.
