Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or other exclusion grounds listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning, where permitted. The bidder must also provide the names and personal identification codes of authorised persons, or a confirmation that no such persons exist, so that the contracting authority can check exclusion grounds. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and that it will not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment; for an Estonian bidder, this means the commercial register. The average net turnover for the last three financial years completed by the start of the procurement must be at least EUR 70,000 per year for the period 01/01/2023–31/12/2025. Joint bidders may aggregate turnover figures. For technical capacity, the bidder must have properly performed at least one sales contract for a texture analyser or a similar laboratory device analysing quality parameters within the last 60 months, with a value of at least EUR 55,000 excluding VAT. If this cannot be verified from public databases, a buyer’s or client’s confirmation of the contract must be provided. The bid must also include the technical compliance form and, where relevant, documents explaining equivalence and warranty terms.
