Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the company nor its managers, legal representatives or supervisory board members have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or related acts, money laundering, child labour or human trafficking, or other grounds listed in the tender documents. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full precise list, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must have completed at least 2 sales or rental contracts for Microsoft or equivalent software licences within the 36 months preceding the start of the procurement. Each contract must have a value of at least EUR 300,000 excluding VAT. If a contract is still being performed, it must have been performed to the required extent; if performance continues after the tender submission deadline, only the part delivered to and accepted by the buyer by the start of the procurement is counted as completed. The bidder must submit a list of those contracts, including their values, performance periods, dates and the other party’s contact details. In addition, the bidder must provide a document issued by Microsoft or the software manufacturer confirming the right to resell licensing solutions (License Solution Provider) under the Enterprise Subscription Agreement in the Estonian region. If the tender is submitted jointly, a joint bidders’ power of attorney must be attached. The bidder must also confirm that the tender complies with the tender documents, that equivalence has been explained where necessary, and that the required evidence has been attached.
