Compliance requirements

The bidder is excluded if it is bankrupt or being liquidated, if bankruptcy or liquidation proceedings have been opened against it, if its business activities have been suspended, or if it is in a similar situation. Exclusion also applies if the bidder has unpaid state taxes, fees or environmental charges, or tax or social security contribution debts, unless these have been deferred or paid within the required time limit. The bidder must not be subject to the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act. If this cannot be checked in public registers, the relevant evidence must be submitted. The bidder’s employees’ average wage during the reference period must be at least 70% of the average wage in the relevant field for the contract subject; this requirement does not apply if the bidder has no employees. A foreign bidder must provide equivalent proof from the competent authority in its country of establishment. The bidder must not be a related person to the technical consultant advising the contracting authority on the reconstruction of the apartment building. If the absence of exclusion grounds cannot be verified from registers, the required documents must be submitted within 10 calendar days.

Qualification criteria and exclusion grounds

The bidder must have filed a notice in the economic activities register for construction activities covering general construction, indoor climate systems, and water supply or sewerage systems within the building or connected to it. For electrical works, the bidder must also have a notice for electrical works covering construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be entered to the nearest 1 euro. By the time the construction contract is signed, the bidder must be able to provide a first-demand guarantee issued by a credit institution, financial institution or insurance company in the amount of 5% of the contract value excluding VAT. Alternatively, the same amount may be deposited to the contracting authority’s bank account or to a notary’s account, provided the beneficiary remains the contracting authority throughout the construction period. Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full reconstruction of a building as the main contractor, including at least the construction or reconstruction of load-bearing and external envelope structures, heat-recovery ventilation, and a new heating system. The bidder’s team for the complete reconstruction of the apartment building must include at least a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage specialist, and a qualified person for electrical works. The required professional qualifications or equivalent competence are specified in the tender documents.
