Compliance requirements
The contracting authority will exclude a bidder if the bidder or persons with representation, management or control rights are subject to any exclusion ground under § 95(1) of the Estonian Public Procurement Act. This includes participation in a criminal organisation, corruption, fraud, offences related to a terrorist act or other terrorist activity, money laundering or terrorist financing, illegal use of child labour and human trafficking. The bidder must also confirm that it has no tax debt and that the contract would not breach sanctions. If the tender is submitted together with a foreign company, documents confirming the absence of exclusion grounds for that company and its relevant management and representation persons must also be provided if requested by the contracting authority.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 1,800,000 excluding VAT, with at least EUR 600,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify compliance from public data, extracts from annual reports or other evidence must be submitted. Joint bidders may rely on each other’s figures. The bidder must also prove proper performance of at least two substation construction contracts for 330 kV or higher voltage completed within the last 60 months; each contract must have a value of at least EUR 300,000 excluding VAT and must have included design for a 330 kV or higher voltage substation. The contracting authority may request additional documents, including a client confirmation. The bid must also include the required forms: the price schedule, the financing schedule, the technical questionnaires, the team CV and, where applicable, powers of attorney and the joint bidders’ authorisation and confirmation form.
