Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither it nor the persons with authority to represent it have been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, terrorist financing, unlawful use of child labour or human trafficking. The bidder must also confirm that it has no tax debt or social security contribution debt and that the award of the contract does not breach an international sanction or a sanction of the Government of the Republic. If the tender is submitted together with a foreign company, documents confirming the absence of exclusion grounds must also be provided for that company and its authorised representatives.

Qualification criteria and exclusion grounds

The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 1,800,000 excluding VAT, including at least EUR 600,000 in each year. If the bidder relies on the capacities of another entity, it must provide that entity’s signed confirmation of the absence of exclusion grounds, consent to reliance, and participation in contract performance, together with an explanation of how the bidder can use that entity’s experience. The bidder must prove proper performance of at least two substation construction contracts for 110 kV or higher voltage completed during the last 60 months; each contract must have a value of at least EUR 300,000 excluding VAT and must have included design work. If needed, the client’s confirmation or other evidence must be submitted. In addition, the bidder must submit the completed price table, financing schedule, technical questionnaires, team CV and powers of attorney or joint-bid authorisations where the tender is not submitted by the statutory representative or where the bidder participates as a joint bidder.
