Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act § 95(1) points 1, 4 and 5, § 95(4) points 3 or 4, and § 177(2) points 1 and 2 apply to it. The tender documents also require confirmation that no subcontractor subject to replacement under § 122(7) will be used.
Qualification criteria and exclusion grounds
For the low-voltage works, the bidder must have, or ensure through the relevant party, a state-secret handling permit and a computer systems accreditation compliance certificate at CONFIDENTIAL level or higher. If the permit or certificate expires during the procedure or contract period, a new application must be submitted so that access does not lapse.
At least the following persons must be involved in carrying out the works: a responsible chief project manager, a design works manager, a site manager for construction works, a person responsible for low-voltage works, and a person managing the construction of low-voltage systems. Specific professional qualification levels are required for these roles, and some of them must also hold a personal state-secret access permit at CONFIDENTIAL level or higher.
The bidder must also prove previous experience. Within the last 60 months, it must have completed at least two similar design and construction projects for a building with controlled indoor climate and a total enclosed net floor area of at least 2,000 m2, and at least one similar low-voltage systems design and construction project in a building in the internal security or defence and security sector with an area of at least 2,000 m2, or across several buildings with the same total area.
If the bidder relies on another party’s capabilities, it must submit that party’s written and signed consent and any other required documents. The details of the responsible persons must be submitted on the form specified in the tender documents.
The tender documents also require a confirmation that the bidder does not use a subcontractor who would have to be replaced under Public Procurement Act § 122(7).
