Compliance requirements
The bidder is excluded if it is bankrupt or being liquidated, if bankruptcy or liquidation proceedings have been opened against it, or if its business activity has been suspended. A bidder is also excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears, unless the debt has been deferred or paid within the required deadline. In addition, the bidder must confirm that none of the exclusion grounds set out in Section 95(1)(1–3 and 5) of the Public Procurement Act apply to it, that its employees’ average salary meets the required 70% threshold, and that it is not a related party to the technical consultant advising the beneficiary on the apartment building reconstruction. If the check cannot be carried out through public registers, the relevant evidence must be submitted within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered in the Register of Economic Activities under the activity of construction for general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but such bidder must prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT. The bidder must provide a construction-time security in the form of a first-demand guarantee of 5% of the contract value excluding VAT by the contract signing date at the latest, or within 10 calendar days after signing the contract. The bidder must have completed at least one equivalent construction project within the last 60 months, with a value of at least half of the estimated contract value; equivalent work means construction, extension or full-building reconstruction as main contractor, including load-bearing structures and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person competent for electrical works; the required professional or competence certificates and, where applicable, signed confirmations must be provided. The tender must be submitted on the required forms and the tender price must follow the structure set out in the procurement documents.
