Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, or if its business activity has been suspended. Exclusion also applies if there are unpaid state taxes, charges or environmental fees, or unpaid tax or social security contributions, unless the debt has been deferred, paid, or settled within 10 calendar days after notice. The bidder must confirm that none of the exclusion grounds listed in section 95(1)(1–3 and 5) of the Public Procurement Act apply to it and that it is not a related party to the technical consultant advising the beneficiary on the apartment building reconstruction. In a joint bid, these requirements apply to all joint bidders. If the check cannot be carried out through public registers, the relevant evidence must be submitted.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, there must be a registration for electrical works and construction of electrical installations. The registration requirement does not apply to foreign bidders, but they must provide equivalent proof of competence if needed. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The bidder must provide turnover data. Before the construction contract is signed, the bidder must be able to provide, on first demand, a bank or insurance guarantee letter in the amount of 5% of the contract value excluding VAT, or deposit the corresponding amount. Within the last 60 months, the bidder must have performed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. An equivalent project must include erection, extension or full-building reconstruction, including load-bearing structures and external envelope works, heat-recovery ventilation, and construction or reconstruction of a new heating system. Proof must include the project description, time and value, and either the use notice/use permit number or a handover-acceptance report. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The required professional certificates or equivalent evidence must be provided. If the bidder relies on the capacities of other persons, signed commitments from those persons must be attached. The tender must be submitted in the structure required by the procurement documents and the tender form must be included. Conditional tenders are not allowed.
