The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted in the last 5 years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD, where applicable. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, if permitted. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are citizens, residents or entities established in the Russian Federation, or who are more than 50% owned by such persons or entities, or act on their instructions. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act. The bidder must have been active in crop production for at least 2 years; the start of activity must be stated by year. The bid must be submitted in a way that complies with all conditions set out in the tender documents, and conditional bids are not allowed. The bid price must be provided according to the prescribed structure. If the bidder participates in a joint bid, a power of attorney for the joint bidders must be attached. If the bidder relies on the capacities of other entities or uses subcontractors, this must be confirmed accordingly.
