Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted in the last 5 years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD, where applicable. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, if permitted. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are citizens, residents or entities established in the Russian Federation, or who are more than 50% owned by such persons or entities, or act on their instructions. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act. The machine-readable notice did not include precise exclusion grounds; these must be checked in the tender documents.
