Compliance requirements

The tender documents state mandatory and voluntary exclusion grounds. The bidder must confirm that none of the mandatory grounds under Section 95(1) of the Public Procurement Act apply, including convictions related to participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of foreigners, child labour or human trafficking, tax or social security debt, or sanctions restrictions. The bidder must also confirm that none of the voluntary exclusion grounds under Section 95(4) apply, such as serious or repeated breach of a previous public contract or false information about qualification requirements. The documents also include a subcontractor control condition for contract performance, but that is mainly an execution-stage check.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 500,000. The bidder must submit extracts from the reports for the last three completed financial years, or another proof if the data are publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least 6 months must have passed since the end of the last completed financial year by the deadline for submitting tenders. Within the 60 months before the publication of the contract notice, the bidder must have performed at least 3 electrical construction contracts for a network operator within the meaning of the Electricity Market Act, with a total value of at least EUR 500,000 excluding VAT. Form 3, a list of previous electrical construction contracts and, if needed, written confirmations from the other contracting party must be submitted. Within the 36 months before the publication of the contract notice, the bidder must have prepared and handed over to a network operator at least 10 compliant external electrical network construction projects. A project is considered compliant if it was completed on time and no contractual penalty or compensation was paid in connection with it. Form 4 and a list of projects with short descriptions, handover dates and, where available, public procurement register reference numbers must be submitted. The bidder must have at least one person with a valid A-level electrical competence certificate or an equivalent professional qualification as an electrical engineer. If the bidder is not established in Estonia, it must provide confirmation and documents proving that the declared person has the required competence or equivalent qualification. The bidder must submit Form 1, the price schedule, Form 5, the list of workers, and, if necessary, copies of live-line work certificates. The tender price must be in euros excluding VAT, and all mandatory fields in the price schedule must be completed in full. The bidder must also confirm that the required staff and equipment will be available throughout the contract term, that the Estonian language skills of B-, C-persons and switch operators are at least B1, that persons performing work at height have valid rights to do so, and that materials, equipment, databases, software and work forms meeting the contracting authority’s requirements will be used throughout performance of the contract.
