Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other offences listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. It must also be confirmed that subcontractors and suppliers representing more than 10% of the contract value are not linked to the Russian Federation or the Republic of Belarus, and that the bidder is not established or resident in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
At least one concept author must hold a valid architect’s licence or an equivalent professional qualification in an EEA Member State or Switzerland; for an author resident in Estonia, the qualification must be a licensed architect qualification at EQF/EstQF level 7 or 8. The bidder must provide the author’s name and qualification details in the ESPD and, upon request by the contracting authority, a copy of the professional certificate or register extract. The concept must be anonymous, prepared in the required scope and format, and submitted electronically by the deadline. The bidder must submit the Appendix 4 participation application and Appendix 5 name card and confirm that it has the intellectual property rights needed to realise the concept. Design work must use staff with the qualifications specified in point 3 of the design contract. If the participation is joint, an authorised representative must be appointed and a power of attorney and joint liability confirmation must be attached.
