Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, insolvency or liquidation proceedings have been opened against it, its business activity has been suspended, or it is in a similar situation. Exclusion also applies if the bidder has unpaid state taxes, charges or environmental fees, or tax or social security contribution debts, unless the debt has been deferred, paid, or settled within 10 calendar days after notice.
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply to it, taking into account Section 95(2). It must also confirm that its employees’ average wage during the reference period was not below 70% of the average wage in the same period in the relevant field for the subject of the contract; if it has no employees, this requirement does not apply. A foreign bidder must provide equivalent certificates from the competent authority in its home country.
The bidder and the technical consultant advising the contracting entity on the apartment building reconstruction must not be related persons. In a joint bid, if at least one joint bidder has an exclusion ground, the entire joint bid is excluded. If the required checks cannot be made from public registers, the requested evidence must be submitted within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but the bidder must prove equivalent competence where relevant.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated value of the contract excluding VAT. The notice requires a specific turnover amount to be entered to the nearest 1 euro.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means a main contractor project for the erection, extension or full reconstruction of a building, where at least the following works were carried out: construction or reconstruction of the load-bearing structure and external envelope, construction or reconstruction of a heat-recovery ventilation system, and construction or reconstruction of a new heating system. To prove this, the bidder must provide the project name, building details, time and value of performance, and whether the project met these substantive conditions. Proof of performance must be provided by a building register notice of use or permit number, or a copy of the handover certificate signed by the client and contractor.
The bidder’s team must include: a project manager with at least level 6 professional qualification as a construction engineer or level 6 construction manager; a site manager with at least level 5 qualification as a construction work supervisor; a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer or level 6 construction manager with specialisation in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 qualification as a water supply and sewerage engineer or level 6 construction manager with the relevant specialisation; and, for electrical works, a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed commitments from those persons to participate in contract performance must be attached.
