Compliance requirements
The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, has suspended business activity, or is in a similar situation.
Another exclusion ground is tax, fee or environmental charge debt, or tax or social security contribution debt, unless it has been deferred or paid. If the information cannot be checked in public registers, the contracting authority may request evidence issued no more than two weeks before the deadline for submitting tenders.
The bidder must confirm that none of the exclusion grounds listed in points 1–3 and 5 of section 95(1) of the Public Procurement Act apply and that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, this applies to all joint bidders.
If the required confirmations or evidence are not submitted and the information cannot be verified from public registers, the bidder is given 10 calendar days to remedy the deficiency; after that period the bidder may be excluded.
Qualification criteria and exclusion grounds
The bidder must be registered in the construction activity area, or as a foreign bidder provide an equivalent proof. If electrical works are performed, the bidder must also have registration for electrical works or an equivalent proof.
The bidder’s net turnover for the financial year preceding the start of the procurement must be at least equal to twice the estimated contract value excluding VAT. A proof of the previous year’s net turnover must be submitted with the bid.
The bidder’s team must include the following competent persons: a project manager, a site manager, a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and a person performing electrical works. Each role has a specific professional or competence requirement, for example a level 6 construction engineer or construction manager qualification for the project manager, a level 5 construction work manager qualification for the site manager, the relevant level 6 engineering or construction manager qualification for the ventilation and heating specialist, the relevant level 6 engineering or construction manager qualification for the water supply and sewerage specialist, and at least a class B competence certificate or an electrical engineer qualification for the person performing electrical works. A foreign bidder may prove competence with an equivalent document.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means a main contractor project for the construction, extension or full reconstruction of a building, including at least load-bearing and external envelope works, heat-recovery ventilation works, and construction or reconstruction of a new heating system. Acceptable evidence includes a handover-acceptance certificate or building register data concerning the use notice or occupancy permit.
The bidder must have a quality management system for construction activities that meets at least EVS-EN ISO 9001 and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent systems.
