Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the other exclusion grounds specified in the tender documents. In a joint bid, each joint bidder is treated as a bidder and the exclusion grounds are checked for each of them. The machine-readable notice did not include more precise exclusion details; these must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the economic activities register for construction activities covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. For a foreign bidder, an equivalent proof may be accepted instead of registration. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro. Within the last 60 months, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT. A comparable project means the erection, extension, or full-building reconstruction of a building as the main contractor, and it must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery ventilation system, and the construction or reconstruction of a new heating system. Proof of completion must be provided by a reference to the building register’s notice of use or occupancy permit number, or by attaching a copy of the handover-acceptance certificate signed by the client and contractor. The team must include a project manager with at least a level 6 construction engineer qualification specialising in building construction, or a level 6 construction manager qualification specialising in general construction. There must also be a site manager with at least a level 5 construction foreman qualification specialising in general construction works. In addition, the team must include a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification specialising in indoor climate systems. A water supply and sewerage systems specialist is also required, with at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialisation. For electrical works, the team must include a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. A licensed architect at level 7 must be responsible for compliance with the European New Bauhaus requirements. The name and qualification or competence certificate number of each required person must be provided, and an equivalent qualification is acceptable for a foreign bidder. When submitting the tender, the bidder must confirm compliance with the tender documents, use the contracting authority’s tender form, attach a joint-bid power of attorney if applicable, provide a power of attorney if the tender is signed by an authorised representative, and identify any business secrets if the tender contains them. If team members are not the bidder’s employees, their written consent to participate must be attached.
