Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–3 and 5 of the Public Procurement Act apply, subject to the statutory exceptions. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business activity has not been suspended. In addition, the bidder must have no outstanding national tax, fee or environmental charge debts, and no tax or social security contribution debts under the law of its country of establishment.
The bidder must confirm that its employees’ average remuneration during the reference period was higher than 70% of the average remuneration for the same period in the relevant field of the contract. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure. Evidence must be provided by an extract from the Tax and Customs Board or, for a foreign bidder, by an equivalent document from a competent authority; in a joint tender, evidence must be submitted for each joint tenderer.
The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must have filed a notice in the economic activities register for the activity of construction covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering the construction, including installation, of electrical installations. A foreign bidder may prove competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint tender, turnover may not be aggregated; it is sufficient if at least one joint tenderer meets the requirement on its own.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction work as the main contractor with a value of at least half of the estimated contract value excluding VAT. An equivalent work must have involved the erection, extension or full reconstruction of a building and at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a heating system. To prove this, the bidder must provide a reference to the building register notice of completion or occupancy permit number, or a copy of the handover-acceptance act signed by the client and contractor.
The team must include a project manager with at least level 6 professional qualification as a construction engineer specialising in building construction or level 6 qualification as a construction manager specialising in general construction; an on-site manager with at least level 5 qualification as a construction site supervisor; a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer or level 6 qualification as a construction manager specialising in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 qualification as a water supply and sewerage engineer or level 6 qualification as a construction manager; and a person involved in electrical works with at least a class B competence certificate or level 6 qualification as an electrical engineer. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. A foreign bidder may use an equivalent qualification.
The bidder must also confirm that it can provide a performance security equal to 5% of the contract value by the contract signing date at the latest, or within 10 calendar days after signing. In addition, a quality management system and an environmental management system are required in the construction activity area; the machine-readable notice did not fully show the exact standards, so they must be checked in the tender documents.
