Compliance requirements
The bidder must confirm that none of the exclusion grounds under the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the specific exclusion grounds listed in the tender documents. In a joint bid, each joint bidder is treated as a bidder and the checks apply to all joint bidders. The bidder must also confirm that its average wage during the reference period was above 70% of the average wage in the relevant field and, if requested, provide a Tax and Customs Board extract or an equivalent certificate from the bidder’s home country authority. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity categories for general building construction, indoor climate systems, and internal or adjoining water supply or sewerage systems. For electrical works, the bidder must also have the registration for electrical works covering the construction and installation of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own.
Within the last 60 months, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT. A comparable project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, forced ventilation with heat recovery, and the construction or reconstruction of the heating system. To prove the work, the bidder must provide the number of the occupancy notice or building permit in the building register, or a copy of the handover-acceptance certificate signed by the client and contractor.
The team must include: a project manager with at least a level 6 construction engineer qualification or a level 6 construction manager qualification; a site manager with at least a level 5 construction foreman qualification; a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification; a water supply and sewerage systems specialist with at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification; and, for electrical works, a person with at least a Class B competence certificate or a level 6 electrical engineer qualification. For each role, the bidder must provide the person’s first and last name and the number of the professional or competence certificate. For a foreign bidder, equivalent competence is acceptable.
The bidder must confirm acceptance of the 5% performance-period security requirement, which may be provided by a credit or financial institution guarantee, by depositing the amount into the beneficiary’s account, or by depositing it into a notary’s account. The security must be available by the contract signing date at the latest, or within 10 calendar days after contract signing.
The bid must be submitted on the beneficiary’s form, and where applicable the bidder must add the joint bidders’ power of attorney, proof of representation, confidentiality marking, and documents proving equivalence. If team members are not the bidder’s employees, their written consent must be attached.
The machine-readable notice did not include any more precise requirements for the quality management system and environmental management system; these must be checked in the official tender documents. The same applies to any other missing precise compliance requirements.
