Compliance requirements

The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, has suspended business activities, or is in a similar situation. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts. No exclusion applies if the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after receipt of the relevant notice. In addition, the bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, and that the bidder and the technical consultant advising the beneficiary on the reconstruction of the apartment building are not related persons. If the absence of exclusion grounds cannot be checked from public registers, the contracting authority may request evidence and give 10 calendar days to submit it.

Qualification criteria and exclusion grounds

The bidder must be registered in the economic activities register for construction, with activity types covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. This registration requirement does not apply to foreign bidders, who may prove equivalent competence instead. For electrical works, the bidder must have a registration notice in the economic activities register for electrical works, specifically for the construction, including installation, of electrical installations. A foreign bidder may again provide equivalent proof. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value, excluding VAT. If proof is required, a turnover certificate must be submitted. The bidder must be able to provide, no later than the contract signing date, a bank or financial institution confirmed performance security in the amount of 5% of the construction contract value. The security must remain valid throughout the construction period; it may also be provided by depositing the relevant amount into the beneficiary’s or a notary’s account, provided the beneficiary remains the entitled party for the whole construction period. The bidder’s team must include qualified persons, or persons with equivalent competence: a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person performing electrical works. The notice specifies the required professional qualifications, including, for example, level 6 construction engineer or construction manager qualifications for the project manager, level 5 construction foreman qualification for the site manager, level 6 relevant engineering or construction manager qualifications for the ventilation and heating specialist, level 6 relevant engineering or construction manager qualifications for the water supply and sewerage specialist, and at least a class B competence certificate or level 6 electrical engineer qualification for the electrical works performer. The bidder must have carried out at least one equivalent construction work within the 60 months before the start of the procurement procedure, with a value of at least half of the expected contract value. Equivalent work means building erection, extension or full-building reconstruction as the main contractor, including at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. The bidder must have a quality management system in construction that meets at least EVS-EN ISO 9001 and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent conditions. If proof is requested, the bidder must submit a description of the system or another supporting document.
