Compliance requirements

The bidder must confirm the standard exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation or corruption, unless the exclusion period has already expired. Qualification criteria and exclusion grounds

The bidder must have experience, within the last 3 years before the publication of the contract notice, in selling the products offered in this tender. For each offered product, the bidder must have sold at least one third of the quantity planned by the contracting authority in Annex 1 during the framework agreement period. To prove sales experience, the bidder must submit a list of properly performed sales contracts or transactions, showing the exact product name, quantity sold, contract dates, contract value and the other parties. The bidder’s company must employ, or otherwise engage under a contractual basis, a product representative who has been trained by the manufacturer or has completed training for the products covered by the tender. Upon the contracting authority’s request, copies of documents proving that person’s training or competence must be provided. The bid must comply with the technical specification and the Annex 1 form. The exact product name, manufacturer, product code or reference number, description of all sub-sections and the actual parameters must be entered in Annex 1. Prices must be stated in euros to two decimal places, both per product and as the total value of the lot. The price must include delivery, unloading and the required training. The bidder must have the right to represent and sell the offered products in Estonia. A document or copy issued by the manufacturer, or by the manufacturer’s authorised representative if the manufacturer is not established in the European Union, must be submitted as proof; in case of sub-delegation, the corresponding additional documents must also be provided. In the case of a joint bid, a authorised representative must be appointed and a power of attorney and a declaration of joint and several liability must be submitted. The bidder must also submit the application, the trade secret explanation, the equivalence confirmation, the sanctions confirmations, the technical specification and the document proving representation rights.
