Compliance requirements

The bidder may be excluded if it is bankrupt or being liquidated, if bankruptcy or liquidation proceedings have been opened, or if its business has been suspended. The bidder may also be excluded if it has tax, fee or environmental charge arrears, or arrears of tax or social security contributions, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after notice. The notice also refers to the general exclusion grounds under the Public Procurement Act, the absence of a conflict of interest with the technical consultant, and the need to provide evidence if the contracting authority cannot verify the absence of exclusion grounds from public registers. If the required evidence is not submitted within the deadline, the bid may be excluded.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated value of the contract, excluding VAT. During the 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. The bidder must be able to provide, at contract signing or no later than 10 calendar days after signing, a performance bond amounting to 5% of the construction contract value; the bond may also be provided by depositing the money on the contracting authority’s or a notary’s account. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and the person performing electrical works, each with the required professional qualification or an equivalent qualification. The bidder must have the required business activity notices for construction and electrical works, unless it is a foreign bidder, in which case equivalent proof may be provided in another way. The bidder must also have a quality management system in construction works compliant with EVS-EN ISO 9001 and an environmental management system compliant with EVS-EN ISO 14001, or equivalent. If the requirements cannot be verified from public registers, evidence or free-form explanations must be submitted by the deadline set in the tender documents.
