Compliance requirements

The machine-readable notice included exclusion grounds. The bidder must not be bankrupt or in liquidation, must not have bankruptcy or liquidation proceedings opened against it, and must not have its business suspended or be in a similar situation under the law of its country of establishment. The bidder must not have tax, fee or environmental charge arrears, or tax or social security contribution arrears, unless the debt has been deferred, paid, or is being paid or deferred within 10 calendar days after notice of the exclusion ground. The bidder must also confirm the general exclusion grounds under the Public Procurement Act, and that its average employee salary was not below 70% of the average salary in the relevant sector during the reference period. The bidder and the technical consultant advising the housing association reconstruction must not be related persons. If the bidder does not submit the required evidence and the exclusion grounds cannot be checked from public registers, the contracting authority may request documents within 10 calendar days.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. A foreign bidder may provide an equivalent proof instead of local registration. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro. By submitting the tender, the bidder must be able to provide, by the date of signing the construction contract, a guarantee letter issued by a credit institution, financial institution or insurance company for 5% of the construction contract value excluding VAT. The guarantee may also be provided by depositing the corresponding amount into the contracting authority’s or a notary’s account, provided that the beneficiary remains the contracting authority throughout the construction period. Joint bidders may satisfy the guarantee requirement together. An equivalent project means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, or the construction or reconstruction of a new heating system. For the complete reconstruction of the apartment building, the bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The project manager must have at least a level 6 construction engineer qualification with a specialisation in building construction, or a level 6 construction manager qualification with a specialisation in general construction. The site manager must have at least a level 5 construction foreman qualification with a specialisation in general construction works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification, or a level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification, or a level 6 construction manager qualification with a specialisation in the construction of internal or building-related water supply and sewerage systems. For electrical works, the person must have at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons for specialists, signed commitments from those persons to participate in contract performance must be included. The names and qualification certificate numbers of the project manager, site manager and other required specialists must also be provided.
