Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither the bidder nor the persons entitled to represent, decide for, or control the bidder have been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement, aiding or attempt, money laundering, or terrorist financing. The bidder must also confirm the absence of convictions related to enabling work for an illegally staying foreign national, unlawful child labour or human trafficking, and that the bidder has no tax, fee or social security contribution debt. The bidder must confirm that entering into the contract would not breach an international sanction or a sanction of the Government of the Republic. If the bid involves a foreign company, supporting documents proving the absence of exclusion grounds must be submitted for that company and its relevant representatives or controlling persons.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 600,000 excluding VAT, with at least EUR 200,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the information from public sources, extracts from annual accounts or other evidence must be submitted on request. Joint bidders may rely on each other’s figures. The bidder must have properly performed at least two construction contracts for the secondary part of a 110 kV or higher-voltage substation within the last 60 months, including design and commissioning. Each contract must have had a value of at least EUR 120,000 excluding VAT, and at least EUR 120,000 excluding VAT must have been paid to the bidder under each contract. If needed, the client’s confirmation or other evidence must be provided. The bidder must also submit reference details: contract name or description, client name and contact details, contract period, and value. If the bidder relies on another company’s resources or experience, a written confirmation from that company is required covering the absence of exclusion grounds, consent to reliance, participation in contract performance, and joint liability. The bid must include a team CV, a bid security of EUR 3,000, a price schedule, substation primary schematics with protection layout, factory certificates for the RTU and batteries, completed questionnaires, and a financing and works schedule. If the bid is submitted by someone other than the legal representative, a power of attorney must be provided. If the bid is submitted jointly, a joint bidders’ power of attorney and confirmation must be submitted.
