Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply to it, taking into account § 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business is not suspended or otherwise in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment. The bidder must confirm that its average wage during the reference period was more than 70% of the average wage for the same period in the relevant field, and this must be proven with a tax authority extract or an equivalent document for a foreign bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations. For a foreign bidder, the registration requirement does not apply, but equivalent proof of competence must be provided if relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own. The bidder must have carried out at least one equivalent construction project within the last 60 months, with a value of at least half of the estimated contract value excluding VAT. An equivalent project must have been the construction, extension or full-building reconstruction of a building as the main contractor and must have included at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and the heating system. For the project, the bidder must provide the project name, timing, value, information on the scope of works, and proof in the form of a use notice, occupancy permit or handover-acceptance report. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a competent person involved in electrical works. The project manager must have at least a level 6 construction engineer qualification with a specialization in building construction or a level 6 construction manager qualification with a specialization in general building works. The site manager must have at least a level 5 construction foreman qualification with a specialization in general building works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification with a specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialization. The person involved in electrical works must have at least a class B competency certificate or a level 6 electrical engineer qualification in consumer electrical installations. For each role, the bidder must provide the person’s name and the number of the professional or competency certificate. For a foreign bidder, equivalent competence is accepted.
