Compliance requirements
In a joint bid, each joint bidder is treated as a bidder. The successful bidder, or all joint bidders in the case of a joint bid, must confirm that none of the exclusion grounds apply. The notice also requires confirmation that the bidder is not bankrupt or in liquidation, has no tax or social security debt, and is not a related person to the technical consultant advising on the apartment building reconstruction. The machine-readable notice did not include any more precise exclusion grounds, so they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the construction activity area for general building works, indoor climate systems, and water supply or sewerage systems inside or attached to a building. For electrical works, the bidder must also have the relevant registration for electrical works, or an equivalent proof if the bidder is foreign.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. In addition, by the contract signing date at the latest, or within 10 calendar days after signing, the bidder must be able to provide a performance security equal to 5% of the contract value; the security must remain valid throughout the construction period. A corresponding amount may also be deposited into the beneficiary’s bank account or with a notary, provided the beneficiary remains the entitled party throughout the construction period.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. An equivalent project means the construction, extension or full reconstruction of a building, and it must include at least the construction or reconstruction of load-bearing structures and external envelope elements, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. To prove the project, the bidder must provide the number of the occupancy notice or occupancy permit in the building register, or a copy of the handover and acceptance certificate signed by the client and contractor.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. The project manager must have at least a level 6 construction engineer qualification with a specialization in building construction, or a level 6 construction manager qualification with a specialization in general building works. The site manager must have at least a level 5 construction work manager qualification with a specialization in general building works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant construction management competences, or a level 6 construction manager qualification with a specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification, or a level 6 construction manager qualification with a specialization in the construction of water supply and sewerage systems inside or attached to a building. The person involved in electrical works must have at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For a foreign bidder, an equivalent qualification is accepted. All these persons must be involved in the performance of the works, and their names and qualification or competence certificate numbers must be provided.
The bidder must also have a quality management system in the construction sector that complies with EVS-EN ISO 9001, and an environmental management system that complies with EVS-EN ISO 14001, or equivalent documents proving the same conditions are met. The machine-readable notice did not include any more precise requirements, so the official tender documents must be checked for details on proofs and forms required for compliance and qualification. The bid must be submitted on the beneficiary’s bid form, and if the bid is a joint bid or submitted by an authorised representative, the relevant power of attorney must be attached. If the bid contains trade secrets, the bidder must identify them and explain why they are confidential. If the bidder relies on equivalence, supporting documents must be provided. If team members are not the bidder’s employees or are not listed in a public register, written consent from each such person must be attached. The bid must be unconditional and must confirm acceptance of all tender document terms, including any required equivalent solutions and supporting evidence.
