Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that the tender is not conditional and that it does not use subcontractors or suppliers accounting for more than 10% of the contract value who are citizens, residents or undertakings established in the Russian Federation, or who are owned or controlled by such persons or act on their instructions. In addition, the bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.

Qualification criteria and exclusion grounds

The bidder must have, within the 36 months before the start of the procurement, at least one properly performed contract for cleaning indoor spaces intended for public use. The serviced cleaning area must have been at least 3,500 m², and the contract must have included experience in using cleaning products that carry the EU Ecolabel for hard-surface cleaning or another Type I ecolabel under EN ISO 14024 officially recognised in the European Union, or an equivalent label. If an equivalent label is used, the bidder bears the burden of proof. If no ecolabel is available, the bidder must provide a conformity assessment audit by a conformity assessment body or an impartial auditor confirming that the product complies with the EU Ecolabel criteria, or other documents proving compliance with the relevant ecolabel requirements. If the contract is still being performed after the tender submission deadline, the bidder may rely on that contract only if it has been performed for at least 12 consecutive months by the time the procurement starts. If part of the contract period falls outside the reference period, only the part and volume performed during the reference period may be used. If the service is provided under a framework agreement, the bidder may rely on contracts or orders concluded and performed under that framework agreement. The bidder must provide in the ESPD the contract details: a short description of the contract subject, the serviced area size, the performance period, the name of the other contracting party, the client representative’s contact details and the procurement reference number. On request, the bidder must provide the client’s confirmation of proper performance. The cleaning manager responsible for service delivery must hold at least the professional qualification “Cleaning Manager, level 5” or an equivalent professional certificate corresponding to EQF level 5, together with the qualification description issued by the country that issued the certificate. If the qualification was obtained abroad, the bidder must provide a certificate from the competent authority under the law on recognition of foreign professional qualifications confirming equivalence. The bidder must also provide additional explanations, data or documents within five working days if requested and if the information is not readily available from public registers or databases.
