Compliance requirements
The machine-readable notice includes the usual exclusion grounds, especially final convictions for participation in a criminal organisation, corruption, fraud and other breaches listed in the Public Procurement Act. The bidder must confirm that neither it nor its management, representation or supervisory body members have been convicted of such offences within the last five years, or that no current exclusion period applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and response options must be checked in the tender documents. The notice also refers to sanctions-related confirmations concerning subcontractors and suppliers, but the detailed wording must be verified in the official documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements beyond the tender documents. The bidder must check the official tender documents for the exact requirements. From the available documents, the bidder must be the manufacturer’s official representative, submit the manufacturer’s confirmation of sales and representation rights, provide at least one service engineer trained by the manufacturer for the period from handover until the end of the contract, and submit a maintenance plan covering 7 years of regular maintenance. For the first lot, the bidder must also submit the technical description/form, product documentation proving compliance, an English user manual and MDS2. The bidder must confirm that the offer complies with the tender documents, that any equivalence has been explained and evidence attached, and that the offer follows the required price structure. If the bid is a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also provide the required contact person details and, where applicable, the business secret explanation and the sanctions-related confirmation regarding subcontractors and suppliers.
