The bidder must confirm that none of the exclusion grounds under section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, tax debt, or social security contribution debt under the law of its country of establishment. The bidder must also confirm that its average wage during the reference period exceeded 70% of the average wage for the same period in the relevant field, and provide proof from the Tax and Customs Board or an equivalent authority for foreign bidders. In a joint tender, proof must be submitted for each joint bidder. The bidder must confirm that it is not a related person to the technical consultant advising on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice for electrical works covering the construction and installation of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated value of the contract, excluding VAT. In a joint tender, this condition is met if at least one joint bidder meets it on its own; turnover may not be aggregated.
The bidder must accept the requirement to provide, by the contract date or within 10 calendar days after signing, a performance security equal to 5% of the contract value. The security may also be provided by depositing the corresponding amount to the beneficiary’s account or a notary account, provided the beneficiary remains the entitled party throughout the construction period.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least 1 equivalent construction project as main contractor, with a value of at least half of the estimated contract value excluding VAT. Equivalent work means construction, extension, or full-building reconstruction of a building, including at least structural and external envelope works, a heat-recovery mechanical ventilation system, and a heating system. The bidder must provide the project name, building details, time and value, indicate whether it was construction, extension or full reconstruction as main contractor, and confirm whether it included the required works. Proof must be provided by a handover-acceptance act or a reference to the building register notice or use permit number.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general building works; an object manager with at least level 5 construction work manager qualification specialising in general building works; a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification specialising in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification specialising in internal or associated water supply and sewerage systems; and, for electrical works, a person with at least a B-class competence certificate or level 6 electrical engineer qualification for consumer electrical installations. Foreign bidders may use equivalent competence. The named persons must be involved in the works and their names and certificate numbers must be provided.
