Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in section 95(1) points 1–3 and 5 of the Public Procurement Act apply, subject to the statutory exceptions. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended. In addition, the bidder must confirm that it has no outstanding national taxes, charges, environmental fees, or social security contributions under the law of its country of establishment. The bidder’s average employee salary during the reference period must have been higher than 70% of the average salary for the same period in the relevant field for the subject of the contract. The reference period is six calendar months, ending with the penultimate calendar month before the procurement procedure started. Proof must be provided by an extract from the Tax and Customs Board or, for a foreign bidder, by evidence from an equivalent competent authority. In a joint bid, each joint bidder must provide the proof. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered for the construction activity in the business register, or provide an equivalent certificate if foreign. For construction works, the registration must cover general building works, indoor climate systems, and internal or building-related water supply and sewerage systems. For electrical works, the bidder must have registration for electrical works covering the construction, including installation, of electrical installations. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover cannot be aggregated to meet this requirement; at least one joint bidder must satisfy it on its own. Within the last 60 months, the bidder must have completed at least one equivalent construction work with a value of at least half of the estimated contract value excluding VAT. An equivalent work means construction of a building, extension of a building, or full-building reconstruction as the main contractor, and it must have included at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of mechanical ventilation with heat recovery, and construction or reconstruction of the heating system. The bidder must provide the project name, building details, execution period and value, and proof by a handover-acceptance certificate, a building register notice/use permit reference, or an equivalent document. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. For each role, the bidder must provide the person’s full name and the number of the professional or competence certificate. The project manager must have at least level 6 construction engineer qualification with a building construction specialisation or level 6 construction manager qualification with a general construction specialisation. The site manager must have at least level 5 construction work manager qualification with a general building works specialisation. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification with the relevant specialisation. For electrical works, the person must have at least a B-class competence certificate or level 6 electrical engineer qualification in consumer electrical installations. Foreign bidders may prove equivalent competence.
