Compliance requirements

The successful bidder will be checked for exclusion grounds. The notice states that the bidder must confirm that neither the bidder nor a joint bidder has the exclusion grounds listed in points 1–3 and 5 of Section 95(1), taking into account Section 95(2) of the Public Procurement Act. The bidder must also confirm that neither the bidder nor a joint bidder is bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against them, and that their business has not been suspended or they are not in a similar situation under the law of their country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security contribution or similar debt under the law of its country of establishment. The bidder must confirm that its average wage during the reference period was more than 70% of the average wage in the relevant sector for the same period. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities under the business activity category “Construction” with the following sub-activities: general construction, indoor climate systems, and internal water supply or sewerage systems. For electrical works, the bidder must also have a registration under “Electrical works” for the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove their competence with an equivalent document. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able to provide a 5% construction-period security by the contract signing date at the latest, or within 10 calendar days after signing. During the previous 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value; an equivalent project means the erection, extension or full reconstruction of a building, including load-bearing structures and external envelope works, heat-recovery ventilation, a new heating system, and water and sewerage works. Evidence must be provided in the form of a handover-acceptance certificate signed by the client and contractor, or data from the building register. The team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and a person competent to carry out electrical works; for each person, the bidder must provide the name and certificate number and, where relevant, proof that they will participate until the handover-acceptance certificate is signed. The bidder must have valid quality management and environmental management system documents for the construction sector, meeting at least EVS-EN ISO 9001 and EVS-EN ISO 14001 or equivalent requirements.
