Compliance requirements

The bidder must confirm that none of the statutory exclusion grounds apply to it or, in a joint bid, to any joint bidder. The notice also requires confirmation that the bidder is not bankrupt, in liquidation, or subject to bankruptcy or liquidation proceedings, and that its business has not been suspended or is not in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that its average wage level during the reference period was above 70% of the average wage in the relevant sector for the same period, and must prove this with a Tax and Customs Board statement. The bidder must also confirm that it is not a related person to the technical consultant advising the recipient on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity register for general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a register notification for electrical works covering the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided if relevant. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The bidder must also confirm that it can provide a performance-period security equal to 5% of the contract value by the contract date or within 10 calendar days after contract signature; the security must remain valid throughout the construction period and may also be provided by depositing the corresponding amount into the recipient’s or a notary’s account. Within the previous 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. The project manager must have at least a level 6 construction engineer qualification with a specialization in building construction or a level 6 construction manager qualification with a specialization in general construction. The site manager must have at least a level 5 construction foreman qualification with a specialization in general construction works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification specializing in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialization. The person involved in electrical works must have at least a class B competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. For all these persons, the bidder must provide the name and the number of the professional or competence certificate. The bidder must have a quality management system in the construction field in accordance with EVS-EN ISO 9001 and an environmental management system in accordance with EVS-EN ISO 14001, or equivalent conditions.
