Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, suspension of business, and tax or social security debt. The bidder must also confirm that its average wage has been above 70% of the average wage in the relevant sector during the reference period. For a joint bid, these checks apply to each joint bidder. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register for construction activities covering general building construction, indoor climate systems, and building-internal or associated water supply or sewerage systems. For electrical works, the bidder must also have the relevant registration for electrical works, specifically the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must provide equivalent proof of competence where relevant.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest euro.
Within the previous 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structures and external envelope, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a new heating system. The bidder must provide the project name, execution period, value, and proof through an acceptance certificate or a reference to the building register’s occupancy notice or occupancy permit.
The team must include a project manager with at least Level 6 professional qualification as a building engineer specialising in building construction, or Level 6 qualification as a construction manager specialising in general building construction. There must also be a site manager with at least Level 5 qualification as a construction foreman specialising in general construction works. The ventilation and heating systems specialist must have at least Level 6 qualification as a heating, ventilation and cooling engineer with the relevant construction management competences, or Level 6 qualification as a construction manager specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least Level 6 qualification as a water supply and sewerage engineer, or Level 6 qualification as a construction manager specialising in the construction of building-internal or associated water supply and sewerage systems. For electrical works, the team must include a person with at least a Class B competence certificate or a Level 6 electrical engineer qualification in consumer electrical installations. All of these persons must be involved in carrying out the works. Foreign bidders may rely on equivalent competence.
The team must also include a licensed architect at Level 7 responsible for ensuring that the design complies with the European New Bauhaus requirements. The machine-readable notice did not include any more precise requirements; they must be checked in the official tender documents. The notice also requires compliance with the tender documents and submission of the prescribed tender form, powers of attorney where applicable, and confirmations regarding equivalent solutions and team members who are not employees.
