Compliance requirements

The machine-readable notice included exclusion grounds confirmations, but not a more detailed list of exclusion grounds beyond the standard confirmations. The bidder must confirm that none of the exclusion grounds under the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened and business is not suspended, that it has no tax, fee or social security contribution debts, and that it is not a related person to the technical consultant advising on the apartment building reconstruction. The exact conditions and the verification procedure must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity area with the relevant activity types for general construction, indoor climate systems, and indoor or adjacent water supply or sewerage systems. For electrical works, the bidder must have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided if needed. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own. Within the last 60 months, the bidder must have completed at least 1 equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means a main contractor project for the construction, extension, or full-building reconstruction of a building, where at least the following works were carried out: construction or reconstruction of load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a new heating system. The bidder must provide the project name, building details, execution time, value, and information on the scope of works. The team must include a project manager with at least level 6 professional qualification as a construction engineer specialising in building construction, or level 6 qualification as a construction manager specialising in general construction. An on-site manager is also required, with at least level 5 qualification as a construction site supervisor specialising in general construction works. The ventilation and heating systems specialist must have at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 qualification as a construction manager specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 qualification as a water supply and sewerage engineer, or level 6 qualification as a construction manager with the relevant specialisation. The person involved in electrical works must have at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate; equivalent competence is accepted for a foreign bidder. The bidder must have a quality management system in the construction field that meets at least EVS-EN ISO 9001, and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent requirements. If requested, copies of the standards or equivalent supporting documents must be provided.
