Compliance requirements

The bidder and members of its management bodies are checked against the usual exclusion grounds, including participation in a criminal organisation, corruption, fraud, terrorism, money laundering, tax arrears, social security contribution arrears, labour-law breaches and other grounds set out in the Public Procurement Act. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted. The contracting authority also checks EU sanctions-related restrictions: entities that are citizens, residents or companies established in the Russian Federation, or persons linked to them, may not be used for more than 10% of the contract value. If this restriction is breached, the bid may be rejected.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. According to the compliance conditions, the bidder must submit a technical specification of the proposed solution at a level of detail that allows the contracting authority to verify compliance with the technical description without ambiguity. If the bidder relies on another entity’s capacities, that entity’s consent must be submitted on form “Annex 4”, and the entity may need to be listed as a subcontractor in the bid’s general data. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bid must include the details of the contract signatory and the contract contact person, and, if the contract is signed by an authorised representative, a power of attorney must be attached. The bid price must be submitted according to the required structure. Where equivalence is claimed, it must be explained and supporting evidence must be attached.
