Compliance requirements
The bidder must confirm that none of the exclusion grounds under section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security contribution or similar debt under the law of its country of establishment.
The bidder must confirm that its employees’ average salary during the reference period was more than 70% of the average salary in the same period in the relevant field for the contract. The reference period is six calendar months, ending with the penultimate calendar month before the procurement procedure started. The bidder must prove this with a Tax and Customs Board extract; a foreign bidder must provide evidence from a competent authority equivalent to the Tax and Customs Board in its country of establishment. In a joint tender, each joint tenderer must provide the proof.
The bidder must also confirm that it is not a related person to Jaak Reed, the technical consultant advising the beneficiary on apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and indoor or associated water supply or sewerage systems. For electrical works, the bidder must also have the relevant registration for electrical works, including installation of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value, excluding VAT. In a joint tender, this condition is met if at least one joint tenderer meets it on its own; turnover may not be aggregated.
The bidder must have completed at least one equivalent construction project during the 60 months before the procurement procedure started. The reference project must have a value of at least half of the estimated contract value excluding VAT and must have been carried out as the main contractor for building erection, extension and/or full-building reconstruction. The reference must include at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a heating system. The bidder must provide the project name, building details, execution time, value, whether it was carried out as main contractor, and whether it included the required works. Proof may be given by a reference to the building register notice or use permit number, or by attaching a copy of the handover-acceptance report signed by the client and contractor.
The bidder’s team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and construction management competence, or level 6 construction manager qualification specialising in general construction. The bidder must provide the person’s name and professional certificate number.
The team must also include a site manager with at least level 5 construction work manager qualification specialising in general construction works. The bidder must provide the person’s name and certificate number.
The team must include a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification with competences in managing construction of heating systems and ventilation systems, or level 6 construction manager qualification specialising in indoor climate systems. The bidder must provide the person’s name and certificate number.
The team must include a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification with competence in construction management, or level 6 construction manager qualification specialising in indoor or associated water supply and sewerage systems. The bidder must provide the person’s name and certificate number.
For electrical works, the team must include a person with at least a B-class competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. The bidder must provide the person’s name and competence or professional certificate number.
The machine-readable notice did not include the full set of quality management, environmental management, or any other precise compliance requirements; these must be checked in the official tender documents.
