Compliance requirements

The bidder must not be subject to the exclusion grounds set out in Section 95(1)(1)–(5) and Section 95(4)(12) of the Public Procurement Act. The bidder must confirm in the public procurement register that these grounds do not apply. If the company has persons not visible to the contracting authority in the commercial register who are authorised to represent the company, make decisions on its behalf or control it, the bidder must provide their name and personal identification code, or confirm that no such persons exist.

Qualification criteria and exclusion grounds

For Lot 1, the bidder’s total net turnover from all business activities in each of the last three completed financial years must be at least EUR 1,500,000 per year. If the financial year does not run from 1 January to 31 December, the figures must be provided for the relevant financial-year periods. On request by the contracting authority, the bidder must submit the financial statements or extracts for the last three financial years if the data are not available from public registers. If the bidder relies on another company’s resources to prove turnover, it must submit the consent form in Annex 10, in which the other company confirms the permitted amount of turnover support, that it will provide financial resources if needed during contract performance, and that it is jointly liable for proper performance of the contract. In the case of a joint bid, information must be provided on the size and nature of the part of the contract to be performed by each joint bidder. The bid must comply with the procurement documents, conditional bids are not allowed, the price must be submitted in the required structure, and for Lot 1 the street maintenance cost table must also be attached. The bidder must confirm environmentally friendly performance, including separate waste collection and recycling and, where possible, the use of environmentally friendly equipment. If equivalence is relied on, explanations and evidence must be attached. If the bid contains trade secrets, they must be identified and justified. In the case of a joint bid, an authorised representative must be named and the power of attorney in Annex 11 must be attached.
